In terms of integrity requirements, expand the supply of high-quality products and services in the domestic market, and improve the safety and controllability of the industrial chain supply chain.
Qiao Dong, a first-level inspector of the inspection department recognized by the General Administration of market supervision, said that the management of the inspection and testing industry should be based on the principle of "who issues the certificate, who supervises; who issues the certificate, who punishes". In addition to the market supervision department, there are other departments that implement the administrative licensing access system in specific inspection and testing fields in accordance with laws and administrative regulations, and are responsible for the supervision of inspection and testing institutions in corresponding fields.
Nan Jun, deputy director of the Law Enforcement and Inspection Bureau of the General Administration of Market Supervision, said that in law enforcement practice, the falsification of inspection and testing reports mainly includes two situations: one is that inspection and testing institutions issue false or false inspection and testing reports; the other is that unqualified enterprises, intermediary agencies, individual industrial and commercial households and individuals illegally trade or use forged or altered false inspection and testing reports.
For inspection and testing institutions and personnel who forge inspection results and issue false inspection and testing reports, the market supervision department and relevant departments may, in addition to imposing fines, confiscation of illegal income and other administrative penalties, cancel their inspection qualifications if the circumstances are serious; if losses are caused, they shall be in accordance with the law Bear the corresponding liability for compensation; if a crime is suspected, criminal responsibility shall be investigated in accordance with the law. At present, there have been judicial cases of criminal responsibility for illegal acts of false inspection and testing.
In 2021, the market supervision department investigated and dealt with 1235 illegal cases of inspection and testing institutions, an increase of 23.5 percent over the same period last year, and the amount of fines and confiscations was 27.277 million billion yuan, an increase of 44.7 percent over the same period last year. At the same time, the market supervision department will incorporate the administrative punishment information for false and false inspection and testing illegal acts into the credit platform such as the national enterprise credit information publicity system, include it in the list of serious violations and dishonesty, and collect it under the name of inspection and testing institutions, so as to promote the implementation of joint punishment for dishonesty.
In 2021, in response to the chaotic problem of some online merchants carrying out false inspection and testing reports without qualification permission and in the name of "no sample report" and "inspection and testing package", the General Administration of Market Supervision will deploy a special rectification action to crack down on the illegal behavior of online sales of counterfeit inspection and testing reports, urging 1886 online trading platforms to verify the qualifications of operators in 480000 platforms and more than 1000 million pieces of commodity information, 5023 operators disposed of illegal platforms and 31 cases of illegal activities were investigated.
Qiao Dong said that qualified inspection and testing reports are important documents for resolving quality disputes. False inspection and testing reports not only disrupt normal business order, but may also cause product quality problems and pose risks to consumers' lives, health and property safety.
For the inspection and testing report, if consumers have doubts about its authenticity or want to inquire about the specific contents of the report, they can first consult directly with the inspection and testing institution that issued the report, and the relevant information of the institution should be listed on the inspection and testing report. In addition, through the "Comprehensive Supervision Service Platform for Inspection and Testing Institutions" of the General Administration of Market Supervision, 1.8 billion inspection and testing reports issued by inspection and testing institutions since 2016 can be inquired.
