The General Administration of Market Supervision recently issued two regulations, "Regulations on the Supervision and Administration of Special Equipment Production Units Implementing the Responsibility of Production Safety Subjects" and "Regulations on the Supervision and Administration of Special Equipment Users Implementing the Responsibility of Use Safety Subjects", which will be implemented on May 5 this year. According to these two regulations, special equipment production units should be equipped with quality and safety directors and quality safety officers, and user units should be equipped with safety directors and safety officers, establish and improve the working mechanism of "daily control, weekly inspection, and monthly scheduling", and refine responsibilities. If the elevator fails or has a problem, the user should be responsible for solving it. If there is no property company, all owners or industry committees must entrust elevator maintenance units or professional companies to use elevators. If the user unit cannot be determined, the township people's government and sub-district office where the elevator is located shall coordinate to determine the user unit, or assume the responsibility of the user unit.

The relevant provisions are as follows:

Chapter 6 The Elevator 

Article 68Elevator users shall purchase and use elevators that meet the relevant safety technical specifications and standards for elevators for mechanical and electrical equipment installed in the hoistway of civil buildings and transporting people and goods by means of carrying devices running along rigid guide rails.

Article 69Elevator users shall be equipped with elevator safety directors and elevator safety officers in accordance with the law, and the post responsibilities of elevator safety directors and elevator safety officers shall be clarified.

The main person in charge of the elevator user unit is fully responsible for the safety of the elevator use of the unit, and establishes and implements a long-term mechanism for the main responsibility of the elevator use safety. The elevator safety director and elevator safety officer shall assist the main person in charge of the unit to do a good job in the safety management of elevator use in accordance with their post responsibilities.

Article 70The main person in charge of the elevator user unit shall support and ensure that the elevator safety director and elevator safety officer carry out the safety management of elevator use in accordance with the law, and shall fully listen to the opinions and suggestions of the elevator safety director and elevator safety officer before making major decisions related to elevator safety.

When the elevator safety officer discovers that the elevator has a general accident hazard, he shall immediately take corresponding measures or notify the elevator maintenance unit to eliminate it; when a serious accident hazard is found, he shall immediately order the suspension of use and report to the elevator safety director, who shall immediately organize Analysis and judgment, take disposal measures to eliminate serious accident hazards.

Article 71The elevator user unit shall, according to the number, use and use environment of the elevators of the unit, be equipped with the elevator safety director and a sufficient number of elevator safety officers, and specify the responsible elevator safety officers one by one.

Article 72The elevator safety director and elevator safety officer shall have the following elevator use safety management capabilities:

(I) familiar with the elevator use of relevant laws and regulations, safety technical specifications, standards and the unit's elevator safety requirements;

(II) have the professional knowledge to identify and prevent and control the safety risks of elevator use;

(III) have the ability to perform post responsibilities according to relevant requirements;

(IV) comply with other requirements of laws, regulations and safety technical specifications for special equipment.

Article 73The elevator safety director is directly responsible to the main person in charge of the unit according to the requirements of his duties, and shall undertake the following responsibilities:

(I) organize publicity and implement laws and regulations, safety technical specifications and relevant standards related to elevators;

(II) organize the formulation of the safety management system for the use of elevators, supervise the implementation of the safety responsibility system for the use of elevators, and organize the safety and compliance management of elevators;

(III) organize to formulate special emergency plans for elevator accidents and carry out emergency drills;

(IV) implement the reporting obligations of elevator safety accidents and take measures to prevent accidents from expanding;

(V) safety education and technical training for elevator safety officers, supervise and guide elevator safety officers to do related work;

(VI) in accordance with the provisions of the organization to carry out the use of elevator safety risk assessment work, to develop and supervise the implementation of the use of elevator safety risk prevention and control measures;

(VII) inspect the safety management of the unit's elevator use, report the relevant situation to the main person in charge in time, and propose improvement measures;

(VIII) accept and cooperate with relevant departments to carry out elevator safety supervision and inspection, supervision and inspection, regular inspection and accident investigation, and provide relevant materials truthfully;

(IX) the unit to take out elevator insurance, the implementation of the corresponding insurance management responsibilities;

(X) perform other elevator use safety management responsibilities as required by the market supervision and management department and the unit.

The elevator user unit shall, in accordance with the provisions of the preceding paragraph and in combination with the actual situation of the unit, formulate the responsibilities of the elevator safety director in detail.

Article 74The elevator safety officer shall be responsible for the elevator safety director or the main person in charge of the unit according to the requirements of his duties, and shall bear the following responsibilities:

(I) establish and improve the elevator safety technical files and handle the elevator use registration of the unit;

(II) organize the formulation of elevator safety operation procedures;

(III) and properly keep the special elevator keys and tools;

(IV) organize education and training for elevator operators and technicians;

(V) conduct daily inspection of elevators, guide and supervise the correct use of elevators;

(VI) supervise and confirm the process and results of elevator maintenance, and cooperate with site safety work;

(VII) ensure the normal use of the elevator emergency alarm device, keep the elevator emergency rescue channel unblocked, in the event of failure and trapped people and other emergencies, immediately comfort the relevant personnel, and organize rescue;

(VIII) the preparation of elevator self-inspection and regular inspection plan, supervise the implementation of elevator self-inspection, regular inspection and follow-up rectification work;

(IX) report elevator accidents according to regulations, participate in elevator accident rescue, and assist in accident investigation and aftercare;

(X) perform other elevator use safety management responsibilities as required by the market supervision and management department and the unit.

The elevator user unit shall, in accordance with the provisions of the preceding paragraph and in combination with the actual situation of the unit, formulate the Code for Elevator Safety Officer in detail.

Article 75Elevator users shall establish a dynamic management mechanism based on elevator safety risk prevention and control, combine with the actual situation of the unit, implement self-examination requirements, formulate the "elevator safety risk control list", and establish and improve the daily control, weekly inspection, monthly scheduling work system and mechanism.

Article 76Elevator users shall establish an elevator safety day control system. The elevator safety officer shall inspect the elevators in use every day in accordance with the "Elevator Safety Risk Control List" and the requirements of relevant safety technical specifications and the safety management system of the unit, and form the "Daily Elevator Safety Inspection Record". For hidden safety risks found, the elevator maintenance unit shall be immediately notified to rectify and report to the elevator safety director or the main person in charge of the unit in a timely manner. If no problems are found, they should also be recorded and zero-risk reporting should be implemented.

Article 77Elevator users shall establish a weekly inspection system for elevator safety. The elevator safety director shall organize risk investigation at least once a week, analyze and judge the safety management of elevator use, study and solve the problems found in daily control, and form the "Weekly Elevator Safety Investigation and Management Report".

The elevator safety director shall supervise the whole process or sampling of the maintenance process, and make records, and deal with problems in a timely manner.

Article 78The elevator using unit shall establish the elevator safety monthly scheduling system. The main person in charge of the elevator user unit shall listen to the report on the management work of the elevator safety director at least once a month, summarize the daily management of elevator safety and the investigation and management of hidden risks in the current month, make scheduling arrangements for the key work in the next month, and form the "Minutes of the Monthly Elevator Safety Dispatching Meeting".

Article 79The elevator user shall record and file the establishment and adjustment of the main person in charge, the elevator safety director and the elevator safety officer, the elevator safety risk control list, the responsibilities of the elevator safety director, the elevator safety officer code, and the opinions and suggestions, reports and rectification of problems put forward by the elevator safety director and elevator safety officer for future reference.

Article 80The market supervision and management department shall establish and implement the elevator use safety responsibility system and other management systems, and take the hidden dangers of elevator use safety risks and rectification found in daily control, weekly inspection and monthly dispatching as important contents of supervision and inspection.

Article 81Elevator users shall conduct training and assessment of laws and regulations, standards and professional knowledge for elevator safety directors and elevator safety officers, and at the same time record the training and assessment and file them for future reference.

Local market supervision and management departments at or above the county level shall, in accordance with the guidelines for the assessment of elevator use safety management personnel formulated by the State Administration of market supervision and administration, organize random supervision and random inspection of elevator safety directors and elevator safety officers of elevator users within their jurisdiction, and publish the assessment results. No fees shall be charged for supervision and random inspection and assessment.

If the supervision and random inspection is unqualified and no longer meets the requirements for the use of elevators, the user shall immediately take corrective measures.

Article 82The elevator user shall provide the necessary working conditions, education and training and post treatment for the elevator safety director and elevator safety officer, and fully guarantee their performance of their duties according to law.

Encourage elevator users to establish incentive and restraint mechanisms for elevator safety directors and elevator safety officers, commend and reward those who have achieved remarkable results, and punish those who fail to perform their duties.

When investigating and dealing with the illegal acts of elevator users, the market supervision and management department should take the implementation of the safety subject responsibility of elevator users as an important factor to judge their subjective fault, illegal circumstances, the range of punishment and so on.

If the elevator user unit and its main person in charge fail to adopt the opinions or suggestions put forward by the elevator safety director and elevator safety officer in accordance with Article 70 of these regulations without justifiable reasons, it shall be deemed that the elevator safety director and elevator safety officer have performed their duties in accordance with the law and shall not be punished.

Article 83In violation of these provisions, the installation of mechanical and electrical equipment that does not belong to the elevator mentioned in Article 68 in the hoistway of civil buildings to transport people and goods shall be ordered to stop using, dismantle or reinstall the elevator that meets the requirements within a time limit. Those who fail to make corrections within the time limit shall be punished by the local market supervision and management department at or above the county level in accordance with Article 84 of the the People's Republic of China Special Equipment Safety Law.

Article 84If the elevator user fails to establish a safety management system in accordance with the regulations, or fails to equip, train, and assess the elevator safety director and elevator safety officer in accordance with the regulations, the local market supervision and management department at or above the county level shall order corrections and give a notice of criticism; if it refuses to make corrections, A fine of not less than 5,000 yuan but not more than 50,000 yuan shall be imposed, and the punishment shall be included in the national enterprise credit information publicity system. Where laws and administrative regulations provide otherwise, they shall be implemented in accordance with their provisions.

If the main person in charge of the elevator user unit, the elevator safety director, and the elevator safety officer fail to implement the safety responsibilities for use in accordance with the regulations, the local market supervision and management department at or above the county level shall order corrections and give a notice of criticism; if they refuse to make corrections, the responsible person shall be fined 2,000 yuan up to 10,000 yuan. Where laws and administrative regulations provide otherwise, they shall be implemented in accordance with their provisions.

Article 85The elevator use unit refers to the actual exercise of the elevator use management unit. In accordance with one of the following circumstances for the use of elevator units:

If the new installation of the (I) is not handed over to the owner, the project construction unit is the user;

(II) a single property right and self-management, the elevator owner is the use of the unit;

If the (III) entrusts the management of market entities such as property service enterprises, the entrusted party is the user;

If the elevator installed in the house is (IV) rented or the elevator is rented, the rental unit is the user unit, and if the law provides otherwise or the parties agree otherwise, the provisions or agreements shall be followed;

If the (V) belongs to the common property right, the co-owner shall entrust the property service enterprise, maintenance unit or professional company and other market subjects to manage the elevator, and the entrusted party is the use unit.

If the user unit cannot be determined except for the above circumstances, the township people's government and sub-district office where the elevator is located shall coordinate to determine the user unit, or the township people's government and sub-district office where the elevator is located shall bear the responsibility of the user unit.

Article 86The meanings of the following terms in these Provisions are:

The main person in charge of the (I) elevator user unit refers to the legal representative, legal representative or actual controller of the unit;

The (II) elevator safety director refers to the management personnel in charge of elevator safety in the management of the unit;

The (III) elevator safety officer refers to the inspector of the unit who is specifically responsible for the safety of the elevator.
