Guide for the installation of elevators in existing residential buildings in cities and towns of Guizhou Province

(Trial)

In order to implement the national and provincial work arrangements for the installation of elevators in existing residential buildings, improve the housing conditions and living environment of existing residential residents in our province, improve the living quality of existing residential buildings in cities and towns, and facilitate the lives of residents, according to the Civil Code of the People's Republic of China Province, the People's Republic of China Property Law, the People's Republic of China Special Equipment Safety Law, Guizhou Province Property Management Regulations, Guizhou Province Elevator Regulations and other laws and regulations, combined with the actual situation of our province, the Guidelines for the installation of elevators in existing residential buildings in cities and towns in Guizhou Province (for Trial Implementation) are formulated as follows:

 

Conditions for installing elevator in 1.

The installation of elevators in existing residential buildings in cities and towns adheres to safety first, serving the people, supervision according to law, diversified co-governance, territorial management, and hierarchical responsibility; it should follow the principle of "voluntary owners, government-led, and safety protection. Houses with 4 floors and above that have been built and put into use, have legal property rights, are not included in the scope and plan of house collection, and are not equipped with elevators can apply for the installation of elevators. The installation of elevators shall be applied in units of residential units (or separate buildings).The installation of elevators shall consult the opinions of all owners of the residential unit (or separate building) where the elevator is installed, and with the consent of 1/2 or more owners of the residential unit (or separate building), the applicant shall apply for the installation of elevators on behalf of all owners.
 

2. Implementation Body

All owners of this residential unit (or individual building), as applicants for the installation of elevators, are responsible for the application, fund raising, equipment procurement, project implementation, safety management, maintenance management and other related work, and are responsible for the construction and use of the installation of elevators. Take overall responsibility for quality and safety. The applicant for the installation of elevators can entrust the owner's representative and the owners' committee to organize the implementation of the installation of elevators, or entrust the property service enterprise or the third-party agent construction unit as the implementation subject to organize the implementation. The trustee shall sign an entrustment agreement with the applicant to clarify the rights and obligations of both parties. The implementation subject shall take the initiative to coordinate with the township people's government and the sub district office (community service management organization) to install elevators.
 

3. Implementation Procedures and Methods

(I) unified opinion.The applicant for installing elevators shall fully solicit the opinions of all owners of the residential unit (or individual building), and sign a written opinion with the consent of 1/2 or more owners of the residential unit (or individual building).The owners who hold different opinions should do a good job of coordination. The written opinion shall specify the main body of the project (I. e. the construction unit), the main responsibilities of the applicant or the entrusting unit for the installation of the elevator, the fund raising plan, the project budget estimate, the plan for sharing the cost of elevator operation and maintenance, and the elevator user unit after the installation is completed.

(II) develop programs. The implementation subject organizes the preparation of existing residential elevator installation plans that meet the relevant specifications and standards of urban planning, architectural design, structural safety, fire safety and special equipment.

(III) fund raising. The funds required for the installation of elevators in existing residential buildings in cities and towns can be raised in the following ways:

1.According to who benefits who contributes, the size of the floor benefit and other factors, the owners negotiate the proportion of the joint contribution.The allocation of construction, operation and maintenance costs can be agreed with reference to the following proportions: the third floor is parameter 1, the second floor is 0.5, and the first floor is 0. Starting from the fourth floor, each additional floor is increased by 0.1 coefficients, I .e. the fourth floor is 1.1, the fifth floor is 1.2, the sixth floor is 1.3, and so on.

2. If the existing residence has already paid the special maintenance fund for the residence, the owners whose exclusive part of the residential unit (or separate building) accounts for more than 2/3 of the total area and the owners whose number accounts for more than 2/3 of the total area of the residential unit (or separate building) may apply for the use of the special maintenance fund for the residence according to regulations with the consent of more than half of the owners who participate in the voting and more than half of the voting.

3. Apply for the withdrawal of the owner's housing provident fund in accordance with the provisions.

People's governments at or above the county level shall support the installation of elevators in existing residential buildings and provide financial subsidies.

5. Other legal sources of funds such as social capital investment.

(IV) publicity. The written opinion signed by the owner and the plan for installing elevators shall be publicized at the crossing of the building to be installed with elevators and the public notice board of the residential area, and the publicity time shall be 10 working days. If an objection is received within the publicity period, the implementing entity shall negotiate with the objector to deal with it.

(V) simplify the elevator installation approval procedures. If the planning and design scheme is jointly reviewed and approved by relevant departments, it can be exempted from handling the construction project planning permit; During the construction permit stage, the construction unit only needs to submit the undertaking that the site has the construction conditions, the implementation of construction funds, etc., the construction contract of the construction project (the bid-winning notice shall be provided for the project that must be tendered according to law), and the construction drawings and technical data that meet the construction needs can be filed to replace the construction permit; the elevator installation unit shall handle the construction notification according to the relevant provisions of the the People's Republic of China Special Equipment Safety Law and apply for the elevator installation supervision and inspection. Before the elevator is officially put into use, the construction unit shall organize the joint completion acceptance and implement it in accordance with the regulations of Guizhou Province on elevators.

If the installation of elevators in existing residential buildings in cities and towns involves the need to increase electricity consumption, pipeline relocation and other matters, the implementation subject shall apply to the power supply, pipeline and other departments and go through relevant procedures.

(VI) engineering construction. The construction unit shall organize the construction of the project in strict accordance with the scheme of installing elevators in existing residential buildings. The construction process is subject to the quality and safety supervision of the special equipment safety supervision and management department and the construction project quality and safety supervision department.

(VII) for use registration. After the completion and acceptance of the project of installing elevators in existing residential buildings in cities and towns, the elevator user unit shall register with the special equipment safety supervision and management department before it is put into use, and obtain the use registration certificate before it can be delivered for use.

4. related matters

The new part of the existing residential buildings in (I) cities and towns equipped with elevators is jointly owned by the owners of the residential units (or separate buildings). Surveying and mapping will no longer be carried out, the property rights area of each household owner will not be included, and real estate registration will no longer be handled.

The production and operation, use and maintenance, inspection, inspection, supervision and management of elevators installed in existing residential buildings in (II) cities and towns shall be implemented in accordance with the provisions of the "the People's Republic of China Special Equipment Safety Law" and "Guizhou Province Elevator Regulations.
