Recently, some media reported that a tragedy occurred in a residential area in Gongshu District, Hangzhou on June 14. A 2-year-old girl was riding the elevator with her nanny. Because the nanny had been looking at her mobile phone, the girl was trapped in the elevator alone on the first floor. After the elevator automatically rose to the 8th floor, the girl walked out of the elevator and climbed up. The window of the elevator hall fell to her death.
The day after the incident, the child's mother, Ms. Zhao, reported that the nanny, Ms. Wu, had caused the death of her 2-year-old daughter. The Gongshu District Branch of the Hangzhou Public Security Bureau believes that the case meets the criminal filing standards and has been filed for investigation. "The nanny's criminal responsibility will be investigated first, and the nanny and the property will continue to be investigated for civil liability."

According to Mr. Chen, his family and his grandmother's family are located in the same building in the same community in Hangzhou, which belong to two units.
The incident occurred on the night of June 14. At that time, Mr. Chen was at home on the third floor, and his 2-year-old daughter was taken by a nanny, preparing to go home from her grandmother's house on the 15th floor of the next unit.
At about 20 o'clock that day, Mr. Chen received a call from the nanny saying that his daughter could not be found.
Mr. Chen hung up the phone and immediately rushed to the next unit to find the child. After hearing the nanny say that the child himself may have been to the 8th floor of this unit, Mr. Chen ran to the 8th floor to look for it. Because he could not find it, Mr. Chen asked the nanny again where the child might be, and the nanny said it was on the first floor. There were different opinions. Mr. Chen no longer trusted the nanny. He began to look for the two units of the whole building layer by layer.
"I began to speculate that the nanny's partner took the child away, because she had only been at my house for 7 days." Worried that the "traffickers" had been hiding on the roof, Mr. Chen rushed to the roof platform, but found nothing.
After returning to the 8th floor, Mr. Chen knocked on the door one by one to ask. The old man in one of the households told him that he did hear the child crying loudly and said, "A woman came up just now".
At this time, Mr. Chen had a foreboding, so he ran to the grass on the first floor to look for the child, but there was still no child in the grass. Later, Mr. Chen saw the window sill protruding out of the corridor window on the second floor. He hurried to the second floor platform, pushed the window open and found the child lying on the platform.
At this time, half an hour has passed since the child fell from the building, and the people are gone.
The child was left crying after the elevator
At noon on June 25, Mr. Chen posted a video on the social platform. The video was shot by a surveillance camera installed in the corner of the elevator car, restoring the incident.
This surveillance video shows that at 20:04 on June 14, the unmanned elevator stopped on the 15th floor. After the elevator door opened, the nanny carried a scooter and entered the elevator with the child.
Then the nanny pressed the button on the first floor and the elevator went down, during which the nanny was watching her cell phone in the elevator. After the elevator came to the first floor, the child seemed to want to touch the elevator button.
The elevator door opened and the nanny said, "Why do you touch so much? It will be dangerous."
At 20:05:13 on the 14th, the nanny took the scooter out of the elevator. When the elevator door was about to close, the nanny looked back and found that the child had not followed. She tried to block the elevator door with a scooter, but it was too late.
Then, the child was locked in the elevator, crying. At 20: 05: 50, the elevator started to go up. After reaching the 8th floor, the elevator stopped.
At 20:06:07, the elevator door opened, the child ran out of the elevator, entered the corridor, and finally disappeared into the camera. The whole process takes about 1 minute from when the child is turned off the elevator to when he leaves the elevator on the 8th floor.
Mr. Chen said that at that time, in order to find a nanny, his daughter climbed up the window of the 45cm high steps beside the corridor on the 8th floor and then fell to the platform on the second floor.
The nanny said she blamed herself.
He said he would accept punishment.
On the afternoon of the 25th, the nanny Ms. Wu told reporters that she was indeed careless and caused irreversible consequences, but she did not deliberately want to hurt the child.
Ms. Wu said that when she got out of the elevator, the child touched the button panel and distracted her.
Ms. Wu told reporters that after the elevator door was closed, she was very panicked and immediately pressed the elevator button. Both the upper and lower keys were pressed, but it was another elevator car that opened the door. She didn't think of any other way, just waiting in the same place to see which floor the elevator the child was in would reach.
After finding that the elevator stopped on the 8th floor, Ms. Wu also went up to the 8th floor, but did not find the child, so she called the child's father and said that the child was missing.
Ms. Wu said that she had been a babysitter on and off for more than a decade. On June 6, she passed the interview with the children's parents and began to take care of the children on the 8th.
"I 've almost collapsed these days. I 'd like to exchange anything for my child's life." Ms. Wu said that she did not want to defend anything. The public security organs had already made a record of her. She would accept "punishment" and wait for legal sanctions.

The nanny is suspected of causing death by negligence.
Mr. Chen also questioned that the nanny, Ms. Wu, clearly knew that the child had fallen on the second floor platform, but said that she did not know, which delayed the rescue time.

She should foresee the result that her actions may cause the death of others, and she did not foresee due to negligence, resulting in the death of others. According to the provisions of the Criminal Law, anyone who causes death through negligence shall be sentenced to fixed-term imprisonment of not less than three years and not more than seven years; if the circumstances are relatively minor, he shall be sentenced to fixed-term imprisonment of not more than three years.
Whether this case is prosecuted and whether it is sentenced to probation or actual punishment depends on the facts and evidence of the judicial organs, and also depends on whether the parents of the girl understand. In addition, Yuan Sanhui, a partner lawyer of Hubei Yisheng Law Firm, believes that when the nanny takes care of the child, he is the child's caregiver. Due to carelessness, the child falls from the building. The nanny fails to fulfill the duty of care and care. The nanny or the housekeeping company to which he belongs should be liable for compensation.
No protective fence for elevator hall windows

The height of the window sill in the elevator hall is less than 50cm, and there is no safety fence on the window.

On the afternoon of the 25th, Mr. Chen told reporters that in the past few days, he had found a cemetery for his daughter. After that, he will hold the relevant parties accountable.
