Q. Why is the elevator dispute in a residential area so fierce in Sichuan?

In area B of Xiangyang garden, Wenjiang district, Chengdu, the elevator installation plan for building a was shelved due to disagreement among residents on high and low floors, while building B on one side was able to install the elevator smoothly because the first and second floors were garages and shops.

A camera is installed in front of the house of a low-rise resident in Building A, Area B, Xiangyang Garden.Elevators are being installed in an old residential area in Wuhou District of Chengdu. The newly-built elevator shaft is only more than one meter away from the windows of the residents on the first floor. Residents hope to clarify the standards such as building concession distance as soon as possible.

Installation of monitoring equipment, preparation of self-defense iron bars, the elderly frightened sent to the hospital ...... Recently, in Chengdu Wenjiang District Xiangyang Garden happened, so that residents confused--

If you open the column

"I'm almost 80 years old, and I'm looking forward to getting on the elevator and going home. Why don't you agree on the first floor." "It was said that it would be safe this year, why hasn't construction started yet?" In recent times, many people have reflected their expectations and worries in the process of installing elevators in old neighborhoods through the Sichuan Daily's public sentiment hotline (028-86968696) or the Sichuan Online Politics Sichuan column.

The installation of elevators in old residential areas is a very realistic and urgent problem: in terms of the total amount, at least 100000 residential buildings in Sichuan have elevator installation demand, and Chengdu currently has about 40000 old residential buildings without elevators. It is also a difficult process: by the end of December 2019, Chengdu has only 162 elevator registration certificates and put them into operation. Compared with the demand, there is a huge gap and the progress needs to be accelerated. At the end of September this year, the General Office of the Sichuan Provincial People's Government issued the "Implementation Opinions on Comprehensively Promoting the Renovation of Old Urban Communities", once again clearly supporting residents in old communities to install elevators.

What are the difficulties in installing an elevator in an old residential area? From now on, Sichuan Daily · Chuanguan News Public sentiment column launched a series of planning, "Where is the difficulty in installing a new elevator in an old building?", focusing on coordination mechanism, funding sources, approval mechanism, industry management and other aspects.

Recently, some netizens reported through the Sichuan online political consultation platform and the Sichuan daily public sentiment hotline (028-86968696) that disputes had arisen in the elevator installation in the old residential area in area B of Xiangyang garden, Fengxi avenue community, Liucheng street, Wenjiang district, Chengdu. some high-level residents resorted to abuse, harassment and threats against the low-level residents who had not signed the installation agreement yet, causing both sides to go to the police station many times.

Why did the owners of Xiangyang Garden Area B make such a noise because of the installation of elevators? Where is the difficulty of installing elevators in old neighborhoods? The reporter conducted an investigation.

The Elevator in the Neighborhood

Fierce clashes between neighbors on high and low floors, elevator installation plans shelved

Recently, the reporter came to Xiangyang Garden. Aunt Yuan, a resident on the 2nd floor of Unit 1, Building A, Area B, pointed to the camera installed above the security door and said to the reporter, "It's all about installing elevators."

Aunt Yuan said that two months ago, because she did not agree to install the elevator, high-level residents abused and harassed her many times. At 11:40 p.m. on September 13, the outsiders who claimed to buy the house on the 6th floor of the building took several people with them., Hit her door with a hammer and an iron bar. "Mediation was carried out after the alarm, and the community also came forward to mediate." Aunt Yuan said, "I already had a heart attack. Because I was frightened, I was 120 and sent to the hospital for emergency treatment. I was forced to install the monitoring."

Wu Gaoquan, a resident on the first floor of Unit 2 in the same residential area, has the same problem. The reporter saw at his door that in order to deal with harassment, Wu Gaoquan's old father, Uncle Wu, prepared sticks and other "self-defense tools" at the door ".

Why did the installation of elevators become like this? Area B of Xiangyang Garden, which was built in 2002, is a typical old community without elevators. Aunt Yuan and Wu Gaoquan are located in the building, because the high-rise residents and the low-rise residents have not negotiated well, until now, no elevator installation plan has been decided.

"More than 90% people agreed, but the lower-level heads of households did not agree, which made it very difficult for us." Zhang Xiaojun, one of the owners of Xiangyang Garden District B who promoted the installation of elevators in the old community, told reporters that like other old communities, the aging situation of the community is relatively prominent. More than 60% of the heads of households are elderly people. "The need to install elevators is urgent."

Aunt Yuan was also very angry: "The elevator is installed on the edge of her living room. Problems such as noise, blocking light, and house devaluation are all real."

Because of the extreme behavior and the difficulty of reaching an agreement among residents, the elevator installation plan for building a in area B of Xiangyang garden was put on hold. "I can't help it. I have to stop for a while and see how to coordinate next." Zhang Xiaojun said.

Is the policy too harsh?

"As long as one household does not agree, the elevator cannot be installed", most sub-provincial cities have relaxed this requirement.

Neighborhood, for the installation of elevators, disputes, such a situation is not a case.

Residents of Jinxing Courtyard, Building 1, Unit 2, Jinshui Street Community, Jiancheng Street, Jianyang City, Chengdu, and Unit 12, Building 1, Liri Qingfeng Community, Guixi Street, High-tech Zone, Chengdu, all called the public sentiment hotline (028-86968696) to reflect the same problem. Ran Ming, a member of the Chengdu Municipal Committee of the Chinese People's Political Consultative Conference who conducted a special survey on the installation of elevators in old communities, told reporters that according to his research, the installation of elevators in old communities was blocked, and more than 80% of the reason was that the owners could not reach a consensus.

"The trouble is, according to the current policy, as long as one household does not agree, the elevator cannot be installed." Fengxi Avenue community party secretary Zhang Hongtao told reporters.

The "Guiding Opinions on the Addition of Elevators in Existing Buildings in Sichuan Province" issued in 2015 clarified that the important implementation condition for the addition of elevators is "with the consent of all owners and residents of the additional elevator number". In August 2018, with reference to the practices of Beijing, Guangzhou, Shanghai and other places, Sichuan adjusted the clause to "the independent addition of elevators in existing residential buildings shall be approved by the owners whose exclusive part of the unit, the building or the residential area accounts for more than 2/3 of the total area of the building and more than 2/3 of the total number of owners, and other owners have no objection."

"Two 2/3, our community has already reached this standard, but the card is stuck on the point of'other owners have no objection." Zhang Xiaojun said.

In this regard, many people believe that the policy is too harsh and should be adjusted. Jiang Yijia, a representative of the Provincial People's Congress, once conducted a survey: Regarding whether residents agree to add elevators, in the vast majority of sub-provincial cities across the country, "2/3 agree" is enough, only Chengdu and Harbin stipulate that "other owners have no objection" "or all agree. The reporter inquired about media reports and found that at the end of last year, Shanghai and other cities also relaxed the conditions for the owner's consent rate to 2/3 the owner's consent.

Whether grassroots organizations are in place

"Residents often worry about not knowing who to find to coordinate when they encounter doubts and contradictions"

Some policies are stricter, while others are not strictly implemented.

The reporter consulted the "Guiding Opinions on the Addition of Elevators in Existing Buildings in Sichuan Province", which clearly stated that "it is necessary to establish a coordination mechanism with township (town) people's governments, sub-district offices, and community neighborhood committees as the main body" and "actively promote residents' policies and Related coordination work". But on this point, the reporter found that some community neighborhood committee leaders did not seem to be clear. The relevant person in charge of Fengxi Avenue Community said: "The installation of elevators in old residential areas belongs to the category of residents' autonomy. It is not good for the community to intervene in advance. It can only be after the residents have negotiated, the community records and applies to the superior for financial subsidies."

Uncle Wu, the owner of Area B of Wenjiang Xiangyang Garden, said that in the process of discussing the installation of elevators in the community, the community neighborhood committee only organized a meeting of all the owners in the early stage. "The subsequent negotiations did not inform us that the owners with different opinions participated." "After the conflict, the community neighborhood committee intervened in mediation, but the relevant person in charge and staff of the street office still did not come forward", zhou Jun, owner of Li Ri Qingfeng Community, Guixi Street, Chengdu High-tech Zone, told reporters that although the elevator building installed in the community is not its own unit, the elevator is located at the entrance and exit of the community garage. "This involves public interests. Many of our owners have raised objections, but people entered the construction directly, and the community neighborhood committee did not coordinate well."

"There are a lot of practical interests. We can only make everyone more and more excited by each other." Residents told reporters. For example, in the dispute over Xiangyang Garden, one of the residents' negotiation points is the issue of compensation. Zhang Xiaojun told reporters that they had proposed to give some compensation to low-level residents, "but some people asked for subsidies of tens of thousands of yuan or even hundreds of thousands of yuan. We can't accept the loss."

Provincial Housing and Urban-Rural Development Department Housing Management Office related staff also noticed this, he told reporters: "Our research found that in the old community elevator installation process, many residents encounter questions and contradictions, often worry about not knowing who to find to solve the coordination. To this end, we will suggest to the relevant departments, to fully strengthen the guiding role of grass-roots organizations."

Fan Fengchun, head of the Department of Administration and Management of the School of Public Administration of Sichuan University, also believes: "In some cases of installing elevators, we have seen that although grassroots organizations are not completely absent, they are far from being in place."

Sound

The owner's consent rate should be relaxed and the compensation standard should be clarified.

How to avoid "conflicts" like Xiangyang Garden Area B in the renovation of old residential areas?

In this regard, Jiang Yijia submitted a proposal this year that existing residential buildings should independently add elevators, "with the consent of owners whose exclusive part of this unit, this building or this community accounts for more than 2/3 of the total area of the building and more than 2/3 of the total number of owners", which he believes is also consistent with the provisions of the property Law.

A collective proposal submitted by the Chengdu Municipal Committee of the China Democratic Construction Association suggested that while relaxing the demand for the owner's consent rate, relevant policies and standards should also be refined to better take into account the interests of high and low floors. "Detailed guidance for elevator installation, exclusive technical management regulations for details such as divergence points and building spacing, building concessions, building height, lighting and ventilation conditions, etc., so as to standardize planning and management with specific indicators."

"In addition to construction standards, the compensation mechanism for high-rise households to low-rise households should also be further clarified." Other experts believe that it must be noted that the installation of elevators will indeed lose some rights and interests of low-rise residents. High-rise residents should compensate low-rise residents. The specific compensation standard can be based on detailed investigation by relevant departments and guidance suggestions according to different types of residential areas. In specific cases, a third-party evaluation with relevant qualifications can also be designated to determine the compensation standard so as not to have no evidence to rely on.

On the other hand, in Fan Fengchun's view, the installation of elevators in old residential areas is an important part of community governance, and grass-roots organizations cannot "get out of the business." otherwise, even if the policy is adjusted, disputes may still arise."

Fan Fengchun said that in the installation of elevators in old residential areas, grass-roots organizations can do a good job in the training of residents in the installation of elevators in old residential areas, build effective communication platforms, provide demonstration cases, and other specific guidance, "giving full play to the guiding power of grass-roots community organizations and grass-roots governments."

Ran holds the same view. "At present, in terms of organization and mobilization, our local governments (sub-district offices), community neighborhood committees, and property companies have no enthusiasm, and they have not done much to guide and persuade opposition owners, but only passively mediate conflicts." He suggested that the street office could set up an elevator coordination and guidance group for existing housing to do more work on the difficulties in progress, especially the resistance from residents and the delay in property management, so as to give full play to the role that residents cannot play independently.

The Stone of Other Mountain

"Old buildings with new ladders" Shanghai does this

In Shanghai, due to factors such as the initiative of the grass-roots government, the number of buildings equipped with elevators increased from 188 in 2018 to 624 in 2019.

Take Yixian Community, Jiangwan Town, Hongkou District, Shanghai as an example. On October 27, 14 units of the community were installed with elevators at the same time, and all elevators will be installed in the community. It is understood that in the process of negotiating the installation of elevators, the role of grassroots organizations cannot be ignored-the community has established a temporary party branch with elevators, so that "every building has a party organization leading and every corridor has a party work advancing., Every party member plays a role in the community" to ensure successful advancement. At the same time, the district housing authority and street leaders have sunk to the first line, and through "weekly regular meetings, weekly analysis and weekly promotion", they have clarified the thread and broken through the resistance for the installation of elevators.
